Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Skintelligent mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App. We reserve the right to update these Terms at any time; continued use of the App constitutes acceptance of any changes.

2. Description of Service

Skintelligent is an AI-powered skincare tracking and insights application. The App allows you to take daily skin photos, receive AI-generated assessments of your skin condition, track trends over time, and follow personalised skincare routines. The App is a wellness tool and is not a medical device. It does not diagnose, treat, cure, or prevent any disease or medical condition.

3. Eligibility

You must be at least 13 years of age to use the App. If you are between 13 and 18, you must have parental or guardian consent. By using the App, you represent and warrant that you meet these requirements.

4. Account Registration

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to notify us immediately of any unauthorised use.

5. Subscriptions and Payments

Skintelligent offers free and premium subscription tiers. Premium subscriptions are billed through Apple’s App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple ID account settings.

Prices may vary by region and are subject to change. Any price changes will take effect at the start of the next subscription period following notice. Refunds are handled by Apple in accordance with their refund policies.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or disassemble the App or its AI models.
• Upload content that is offensive, harmful, or infringes on the rights of others.
• Interfere with or disrupt the integrity or performance of the App or its servers.
• Create multiple accounts for abusive purposes or to circumvent restrictions.
• Use automated means (bots, scrapers) to access the App or extract data.

7. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, AI models, algorithms, and software — are owned by Skintelligent or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes.

8. User Content

You retain ownership of the photos and data you submit through the App. By using the App, you grant Skintelligent a non-exclusive, worldwide, royalty-free licence to process your content solely for the purpose of providing and improving the service. We will never use your photos for advertising, sell them to third parties, or display them publicly without your explicit consent.

9. Medical Disclaimer

The App provides general wellness information and AI-generated insights for informational purposes only. Nothing in the App constitutes medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of information provided by the App.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Skintelligent and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising out of or in connection with your use of or inability to use the App.

In no event shall our total liability exceed the amount you have paid us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or completely secure.

12. Indemnification

You agree to indemnify, defend, and hold harmless Skintelligent and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

13. Termination

We may suspend or terminate your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately. You may also delete your account at any time through the App settings.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Skintelligent operates, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the App following any changes constitutes acceptance of the revised Terms.
